Buyer: Person Ordering on the Website (“Buyer” or “Participant“)

Article 2 – Subject

The subject of this agreement is the sale and delivery of event tickets ordered by the Buyer through the electronic platform at https://zirve.turkiye.ai (“website“), pursuant to Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts, determining the rights and obligations of the parties. The parties acknowledge and undertake that they are aware of and understand their obligations and responsibilities arising from the Law and the Regulation under the Agreement.

Article 3 – Service Subject to the Agreement

The service subject to the agreement is an event ticket for entry into the Turkish Artificial Intelligence Summit (“Event“), with definitions generally provided below:

·       Service Name: Turkish Artificial Intelligence Summit Event Ticket

·       Total Sales Cost: The total price of the ticket and service including all taxes, service fee, delivery costs, and other additional costs, as well as event information, conditions of participation, and ticket delivery procedures are detailed on each event’s ticket page.

·       Payment Method: Credit card, bank card, or other payment options

Article 4 – General Provisions

4.1 The Buyer declares that they have read and are informed about the basic characteristics of the service, sale price, and payment method on the Website and have provided the necessary confirmation electronically.

4.2 The service subject to the contract is delivered to the Buyer as an electronic ticket within the period specified on the Website, not exceeding the legal 30-day limit.

4.3 The Seller is responsible for the sound, complete, and as described delivery of the service subject to the contract.

4.4 Provision of the service requires electronic confirmation of this contract and payment of the service fee through the Buyer’s chosen payment method. If the service fee is not paid or is canceled in bank records, the Seller is deemed relieved from the obligation to provide the service.

4.5 If the electronic ticket cannot be delivered within the service period due to force majeure or extraordinary circumstances, the Buyer will be notified. In this case, the Buyer may request the cancellation of the order, replacement of the service with a similar one, or extension of the delivery period. If the Buyer cancels the order, the amount paid will be refunded in cash and in full within 14 days.

4.6 Buyers do not have the right or authority to transfer the ticket they hold through the system to another third party after purchasing the ticket on the website for any reason. Therefore, the Seller is not obligated or committed to refund or replace with another event and has no financial or moral responsibility whatsoever. However, if the Event announced on the website does not take place on the specified date for any reason other than force majeure, the refund process for the total ticket price to Buyers who have completed the ticket purchase process will be initiated within 7 business days in a manner appropriate to the payment methods used. However, TRAI does not accept any responsibility for travel or accommodation expenses incurred by Buyers.

4.7 TRAI reserves the right to make necessary changes to the records or cancel the registrations with prior written notification.

4.8 All legal and penal responsibilities for transactions and actions performed on the website by individuals who have obtained other people’s information through legal or illegal means to benefit from TRAI’s services belong to the real or legal persons who performed them. TRAI has no legal or penal responsibility due to such actions.

Article 5 – Right of Withdrawal and Refund Guarantee Policy

5.1 According to Article 15(g) of the Distance Contracts Regulation, there is no right of withdrawal for tickets for events that need to be held on a specific date or period. In the following cases, Participants who have purchased tickets may have the right to a refund under the exceptional right of withdrawal granted by TRAI:

·       Change of event date,

·       Change of event location,

·       Cancellation of the event by TRAI.

5.2 To exercise the right of withdrawal, it is mandatory for the Buyer to notify the Seller by email at [email protected] or by a wet-signed petition to the domicile address within 7 days.

5.3 The service fee will be refunded to the Buyer within 14 days following the receipt of the withdrawal notification.

5.4 No refunds will be made for cancellations made less than 14 days before the event date.

5.5 The Consumer shall exercise the exceptional right of withdrawal specified in this article within the period and procedures stated, otherwise, they will not have a right of withdrawal.

5.6 TRAI reserves the right to modify the Refund Guarantee Policy at any time. There is no obligation to notify the Buyers about this matter.

Article 6 – Notifications and Proof Agreement

6.1 All correspondence between the parties under this agreement will be conducted via email, except for the mandatory cases listed in the legislation.

6.2 The Buyer agrees that in the event of disputes arising from this agreement, the Seller’s official books and commercial records and the electronic information and computer records kept in the Seller’s database and servers will constitute valid, binding, conclusive, and exclusive evidence within the meaning of Article 193 of the HMK, and this article is considered a proof agreement.

Article 7 – Protection of Personal Data and Intellectual Rights

7.1 Personal data shared by the Buyer under this contract will be processed and protected in accordance with Law No. 6698 on the Protection of Personal Data.

7.2 The Buyer will be able to access detailed information regarding the processing of their personal data through the Privacy Notice [EM1] for Events.

7.3 The Buyer acknowledges, declares, and undertakes that the personal data provided under the Agreement are accurate, complete, and up-to-date.

7.4 All property rights, including material and intellectual property rights, commercial information, and know-how through the Event and Website owned by TRAI, are reserved.

Article 8 – Contract Changes

The Seller may unilaterally and at its sole discretion change this Distance Selling Agreement at any time by announcing it on the https://zirve.turkiye.ai website. The changed provisions of this Distance Selling Agreement become effective on the date they are announced; the remaining provisions continue to be in effect and produce their effects. This Distance Selling Agreement cannot be changed by the unilateral declarations of the Consumer.

Article 9 – Force Majeure

Force majeure: natural disasters, riots, wars, strikes, communication problems, infrastructure and internet failures, power outages, societal events, changes in election dates, and adverse weather conditions are conditions beyond the control of the parties that prevent them from fulfilling their obligations. Due to force majeure, the Seller cannot be held liable for late or incomplete performance or non-performance of the obligations determined by the contract.

Article 10 – Dispute Resolution

Turkish Law will apply in the interpretation, application, and management of legal relationships arising within the provisions of this agreement. Istanbul Çağlayan Courts and Enforcement Offices will have jurisdiction over any disputes arising or may arise from this agreement.

Article 11 – Duration of Validity

The Buyer acknowledges that they have read, understood, and accepted all conditions of this agreement; the agreement becomes effective on the date it is electronically approved by the Buyer and terminates upon the full and complete performance of the service.
